Pending Florida Legislation to Impact Non-Compete Agreements
The Florida legislature passed a bill creating the “Florida Contracts Honoring Opportunity, Investment, Confidentiality, and Economic Growth (CHOICE) Act,” which favors employers by extending the presumed reasonable non-compete period (from two years to four) and requiring courts to issue preliminary injunctions against former employees and their new employer for alleged non-compete violations. If approved by the Governor, the CHOICE Act will take effect on July 1, 2025.
Employers looking to benefit from this favorable law must ensure that their non-compete agreements comply with the new statute and that the statute applies to the employee. Specifically, the CHOICE Act excludes healthcare professionals and applies to those employees or individual contractors who meet a specific salary threshold.
